Federal judge remains silent on ivermectin

A footnote in the tsunami of government propaganda was a statement made by the National Institutes of Health on January 14, 2021:
“There is insufficient evidence for the COVID-19 Treatment Guidelines Panel (the Panel) to recommend either for or against the use of ivermectin for the treatment of COVID-19”
It is a false statement because the “Panel” never considered the issue. I asked the NIH to confirm that no vote was held on the ivermectin recommendation with a Freedom of Information Act request:
“All updates to the Coronavirus Disease 2019 (COVID-19)
Treatment Guidelines that were endorsed by a vote of the Panel. (Date Range for Record Search: From 01/01/2021 To 01/28/2021)”
The NIH did not respond to that request within the 20 business days allotted by statute nor did they assert an exemption to FOIA. Nor did they claim the need for additional time to compile the material. They simply ignored the request.
I have since filed suit asking the United States District Court in the District of New Jersey to compel the NIH to respond the the FOIA request. NIH then responded to the FOIA request in an email:
“Please be advised that the link you supplied, to wit https://files.covid19treatmentguidelines.nih.gov/guidelines/archive/statement-on-ivermectin-01-14-2021.pdf, is a valid NIH link that directs you to the document responsive to your FOIA request (#55822).”
Unfortunately, NIH declined to provide a FOIA response letter with matching text. NIH instead provided a letter stating:
Please be advised that https://files.covid19treatmentguidelines.nih.gov/guidelines/archive/statement-on-ivermectin-01–14–2021.pdf , is a valid NIH link that directs you to the document responsive to your FOIA request date range from 1/01/2021 to 0/28/2021 (#55822). Additionally, the statement is false. The link in that statement is not valid. When it is copy-and-pasted into the browser the link fails.
The complaint was filed on March 29, 2021. The case has now languished in the court for 269 days. Motions for and against summary judgement were completed on October 29, 2021. The motions have been awaiting a ruling for 54 days from Judge Zahid Quraishi.
A message to Judge Quraishi: You have only been asked to state the obvious. Do your job.
