Rehearing petition denied in Third Circuit for NIH ivermectin deception case
The Third Circuit appellate court ordered that “…the petition for rehearing by the panel and the Court en banc is denied.” In doing so, the court allowed for its own decision to stand affirming the lower court decision to dismiss Yim v. NIH. Yim (me) claimed that NIH did not comply with a Freedom of Information Act request that sought to determine whether the NIH recommendation on ivermectin was the product of a “panel” or simply a diktat. The Third Circuit decision is an embarrassment given that the NIH materially, publicly and indisputably altered the central evidence in the case - as described in the petition.
There is one final recourse - what is known as a petition for a writ of certiorari - ie appeal to the US Supreme court. The chances for review by the Supreme Court as astronomically low but it is at least worth considering.
